WA Resolution: Right of Emigration

Right of Emigration

A resolution to improve worldwide human and civil rights.

Description: OBSERVING that in the countries of the World Assembly, people choose to emigrate from one country to another for many reasons such as:
- Pursuit of ambition, opportunity or refuge or;
- Escape from war, persecution or injustice.

WHEREAS Emigration is defined as an act of a person or more leaving one country in order to settle in another, The World Assembly wishes to promote the right of emigration for such reasons.

The World Assembly therefore,

1. AFFIRMS the right of any person of a member state to emigrate from their current country of residence regardless of their status (such as disability, gender, sexuality, ethnicity or belief) unless the conditions in Section 2 are true.

2. PERMITS member states to waive Section 1 only if any of the following conditions are true:
a) The person is either under penal servitude or undergoing (civil or criminal) legal proceedings;
b) The person holds certain convictions directly linking to sexual offences;
c) The person is below the age of maturity (as defined in their country of residence) and lacks the consent of their legal parents or guardians;
d) The person is either militarily interned during conflict or legally mandated to remain in the current country of residence following a judicial ruling or;
e) The person is suspected of espionage or intention to carry out terrorist acts by emigrating.

3. ENCOURAGES member states to:
a) Help refugees who are fleeing from hostile situations such as: natural disasters, war, persecution or oppressive/unethical governments with respect being given to Section 1 of this resolution.
b) Help such refugees under these situations to travel safely and swiftly to countries that are more tolerant to them, and;
c) Take action or enact appropriate measures to prevent refugees from becoming stateless.

4. EMPHASIZES that this resolution shall have no effect on legislation of member states concerning on immigration.

I disagree with some of the provisions in this Resolution. These are:


3. ENCOURAGES member states to:

b) Help such refugees under these situations to travel safely and swiftly to countries that are more tolerant to them, and;

c) Take action or enact appropriate measures to prevent refugees from becoming stateless.

The main problem with this is that global stability might be jeopardized if Nation-States are allowed to sponsor these activities. Most States will see these activities as hostile and will undertake the necessary preparations and actions to counter it.

Some unscrupulous States might use this as an excuse to pursue some form of human (or sentient being) smuggling.


4. EMPHASIZES that this resolution shall have no effect on legislation of member states concerning on immigration.

If this Resolution has no effect whatsoever on existing State immigration laws then this might increase the number of stateless persons, not reduce them. Remember that most States have strict Immigration laws.

Therefore I vote AGAINST this Resolution. Its purpose is noble and in agreement with the principles of the USSC but it needs more refinement.

I think Hockeynutville should present the WA resolutions and moderate the debate. It's not like he has gone inactive or anything, so there's no need for anyone else to step in. I'm a little uncomfortable with seeing the Delegate diminished like this.

When a resolution says " ENCOURAGES:...something", it is leaving things ultimately at the discretion of the individual states. Human smuggling? If a nation is going to attempt human smuggling, it would be a weak excuse to point to this resolution and say "Look! This resolution "encourages" me to do it!" because it doesn't encourage it, permit it, or even hint it.

I'm okay with this resolution. Most WA resolutions have to be delicately worded so that nations will not feel that their sovereignty is being assaulted. The point is, the resolution is making a statement about the world's opinion on emigration rights. Granted, as legislation it might be a little weak, but I think it should pass.

The ideas on emigration are fine. This resolution doesn't force me to do anything out of the ordinary. It doesn't impede on my rights.

It seems it is just easier for people to leave there current nation and reinforces there rights if they do leave. I do not see any seriously plausible cons to this.

This resolution seems pretty benign to me, so I have no problem voting for it.

Wow, I wish it was that easy in real life, but I can see a ton of problems regarding cultural and politcal reasons.
