The nations of The Lacking of HumanSanity and the Protectorate of Paffnia hereby enter into the Liberal Understanding and Agreement on Commerce (LUAC). Member nations accede to this agreement in order to foster international trade to mutually grow their economies and national well-being and to protect the rights of the environment and those most vulnerable to the impacts of trade, who instead should and shall share fairly in its benefits.
1. Member nations agree to import and export at least sixty percent of traded goods by value between every pair of member nations without tariffs or duties.
2A. Member nations shall endeavor to impose tariffs sparingly and for the primary purpose of protecting the livelihood of their most vulnerable populations.
2B. A tariff may not be imposed with the primary intention or effect of protecting a particular company, as opposed to a broader market segment.
3A. If a member nation has systemically lower average wages or labor standards in an industry with traded goods, beyond the expected variation in other member nations, and has failed to take rectifying steps within three years of being notified by another member nation or has failed to rectify the difference within ten years of being notified, other member nations with higher wages or standards shall be allowed to impose tariffs on goods in that industry in exception to Clauses 1, 2A, and 2B.
3B. All workers involved in the production and distribution of goods traded between member nations shall have the right to collectively organize and bargain for better conditions and compensation, and their duly elected unions must be recognized by employers. Such workers shall also be accorded all labor safety and minimum wage rights agreed upon in other treaties.
4A. Member nations shall convene a panel of scientists, indigenous cultural leaders, and representatives of climate-vulnerable communities with representatives from all member nations who shall set emissions requirements and environmental standards for all goods traded between member nations. This panel shall have the power to ban the interstate trade of certain environmentally toxic goods, to regulate shipping methods of international trade for their environmental impact, and to recommend higher tariffs to achieve environmental goals. Member nations may, as a last resort after negotiations, adopt these tariff recommendations in exception to Clauses 1, 2A, and 2B.
4B. The panel shall not have the power to regulate intrastate trade.
4C. Recognizing that wealthier nations that industrialized earlier contribute more to global environmental problems and have benefited more to date from existing environmentally unsound modes of production and consumption, environmental trade regulations adopted under this clause shall distribute their costs and burdens among nations recognizing this historic inequity. Regulations enacted by the panel shall not be used to put historically disadvantaged nations at a significant competitive disadvantage.
5. All tariff revenue collected on trade between member nations must be spent to the direct benefit of those populations most at risk or most impacted, culturally, economically, socially, or environmentally, by trade of the category of goods upon which each tariff is levied.
6. Member nations are not required to recognize the intellectual property protections of other member nations for the purpose of intrastate trade. Member nations may prohibit the importation of products which would violate the intellectual property of another producer as per the member nation's laws. Member nations are required to recognize the cultural property of indigenous groups in other member nations.
7. Alleged violations of or ambiguities on this treaty shall be settled by binding international arbitration.
8. Member nations shall have the power to pass legislation and agree to treaties to further clarify and define the scope and application of this agreement.
9. Any nation that wishes to join this agreement shall notify all existing members. If, after two weeks, no objection is raised, that nation shall be admitted. If an objection is raised, existing members shall vote on whether to admit the applicant nation. New member nations must post an addendum within one week of joining specifying at least one category of goods the nation intends to trade with other members.
10. If a member nation wishes to make an amendment to these articles, they may notify all other member nations with the proposed amendment. After two weeks, a vote may be held on the proposed amendment. If two-thirds of member nations vote in favor of the amendment, then these articles will be amended. After an amendment is passed, member nations will have six months to attempt compliance or leave the agreement.
