Emigration and Statelessness
A resolution to improve worldwide human and civil rights.

Description: The World Assembly,

OBSERVING that people may emigrate from state to state for many reasons such as: the pursuit of ambition or opportunity; or escape or refuge from war, persecution or injustice;

CONCERNED that a person may become stateless for many reasons such as: emigrating from a member state; or having nationality of a nation that ceased to exist without a successor state;

SEEKING to promote the right of emigration and the reduction of statelessness;

Therefore,

DEFINES for the purpose of this resolution: “Emigration” as an act of leaving a nation to settle in another; “Nationality” as the status of a person belonging to a particular state, where such status grants the automatic right of return to that state, that state's jurisdiction over that purpose and, upon attaining citizenship, grants the person political rights of that state; “Statelessness” as having no nationality of any existing state; and “renunciation of nationality” as where a person wishes to cease being a national of a nation;

1. MANDATES the following, unless any of the situations in Sections 2 and 3 are true:
a) Everyone who is able to make decisions shall have the right to emigrate from their current nation of residence regardless of their status (such as disability, gender, sexuality, ethnicity or belief).
b) Member states must allow the legal parent/guardian(s) of a person unable to make decisions to make such a decision on their behalf and such person should be accompanied by their legal parent/guardian(s) for their safety and well-being;

2. PROVIDES for member states to waive Section 1, if any of the following situations are true:
a) The person is currently: serving in, or drafted to, the armed forces; under penal servitude; or undergoing civil or criminal legal proceedings;
b) To prevent the spread of radiation or contagious diseases; or to contain an ongoing disease epidemic or pandemic;

3. FURTHER PROVIDES for member states to waive Section 1 as a result of a legitimate judicial ruling that is delivered in good faith compliance with clauses 1 and 2 of this resolution;

4. REQUIRES the member state in which the emigrant left to inform the new nation of residence, upon successful emigration, of its criminal history, if the said emigrant has any;

5. MANDATES that member states’ policies regarding the renunciation of nationality must be conditional on a person’s acquisition or possession of another nationality;

6. PROHIBITS member states from depriving a civilian of their nationality, so as to render them stateless, for any reason other than: Acquirement of nationality or citizenship by misrepresentation or fraud; or treason against that member state– unless no other state is willing to take them in;

7. CALLS FOR treaties regarding the transfer of territory (between member states or to a successor member state) to include provisions to prevent statelessness, with respect given to the purpose of this resolution.

8. EMPHASIZES that nothing in this resolution shall be construed to affect member states’ policies on immigration, nor the acquirement of nationality/citizenship, nor internationally established rights pertaining travel.

I wish to put my case for this resolution:

Firstly, this resolution aims to allow the right of emigration: that is, to leave a country, so that every citizen of the WA has a right to pursue an ambition or opportunity; or to escape from war, persecution or injustice.

Secondly, this resolution aims to reduce statelessness so that a person who is a citizen of a member state would have the right of automatic return.

There are many problems with a citizen being rendered statelessness, ranging from diminished civil rights vs. nationals, No country to which one is guaranteed an automatic right of return and frustrations in deportation action where no state could assume responsibility to accept the person subject to a criminal deportation.

I must emphasise the difference between Emigration and Immigration: they are both forms of migration but this resolution concerns emigration only (people moving to settle in another country).

When a person moves out of a country, it becomes a emigrant, having emigrated. When a person moves into a country, it becomes a immigrant, having immigrated. Either way, or even if I move within the same country, I have migrated, and I become a migrant.

So if I migrated from the Nation A to Nation B, I will have emigrated from Nation A to become an immigrant in Nation B.

This resolution promotes the rights of people who leave a country. It does not affect a member state's immigration policy.

This has serious repercussions for developing nations losing valuable members of their society to other nations in the name of "ambition and opportunity." (And obviously benefits developed nations.)

Dr. Castro from Glen Rhodes has stated that the answer to the potential population decline trend is not to force people to live where they do not want to live. I wish to defend that even a developing nation can take measures to create an environment that attracts the 'best and brightest', and it doesn't need a change of ideology.

Developed nations should realise that, tracing back to their core roots, we were once developing nations who had to do the same things to get this far. And trapping people is not exactly conducive to innovation and social progress.

We don't mind having foreigners come and surf our beaches here in Pizmo Beach. They spend money and inject some strange DNA into our women, which stirs up the gene pool like a good stew.

But I don't think we should have to keep them if we don't want to. When I was a kid I brought home a sick puppy and made it a bed out of my mom's towels and then I fed it some leftover sphaghetti. I named it Whiskers.

Then my mom came home and I showed her the puppy. She said, "Oh for Christ's sake. That isn't a puppy, it's a rat." So she made me get rid of it.

I put Whiskers in the neighbor Mrs. Fleigermeir's mailbox. When she opened her mailbox Whiskers bit her. She had to have shots and the police came to my house. I asked the policeman if I could hold his gun and he said no.

So unless we all want to end up having rabies, we should send the foreigners back to where they came from after they are done spending money and pleasing our women.

But when the developed nations were developing - was the economic climate the same and with this resolution in place? If not, how can they suggest to know what the impact of such a resolution would be on developing nations today?

The political and global/regional economic climates would be different as well, with increased global information dissemination and increased ease of travel, pull factors within the more attractive locations would also be stronger than in the past.

"We used to be developing too" seems to be a largely irrelevant statement when speaking in regards to the developed nations of today, as their situation is different not only due to perspective, but context as well.

I think we should be required to open up our borders like this and it makes special exeptions for anyone I would not want in my region vote FOR. The world should be in harmony, not war. How would you like it if lets say a tsunami hit where ever you live and you make it to the border and then the guy tells you to go back and die. DIE! We need to say that anyone of any nationality can go in our borders. We need to make the WA more of a union than a hate group. The WA is getting so big that it is not an alliance any more because WA nations often go to war with other WA nations. We need to say that you can't do that and this is the first step, making it so that you MUST allow others into your nation in there time of need. What would you say when it was you and if it was for REAL and your life and prosperity REALLY depended on it, just use your imagination (that it seems you don't have). Just think, use your brain, and do what I JUST SAID, CHANGE YOUR VOTE!

If what they have chosen then fails, it's not my responsibility to take them back. They should have thought of that before they left.

That's actually the reason I vote early. That way 10ki will help steer the vote. If I wait with casting my vote until the end of the voting period my 450+ votes most likely won't matter.

I've withdrawn my vote for now though, since the forum poll is current 4-4.

Again, I do intend to resubmit with little improvements if the resolution at vote fails but emphasis should be given to disambiguate emigration vs. immigration. Not a serious issue, but it would make ambassadors more informed.
